Your privacy is important to us. This privacy statement explains the personal data Legitify processes, how Legitify (operating from https://app.legitify.eu) processes it, and for what purposes. References to Legitify Products and Services in this statement include Legitify services, website, apps, software, and servers.

This policy applies to any visitor to our website or user of our Products or Services, including casual visitors who do not sign up for the account, visitors who have created the account and users who have been sent to us to certify a document or witness a signature. Legitify collects data through the interactions with them and through our Products and Services. By using this website or any of our Products or Services, you are consenting to this Privacy Policy.

Data collection

You provide some of this data directly, and we get some of it by collecting data about your interactions, use, and experiences with our Products. The data we collect depends on the context of your interactions with Legitify and the used Products and features. We also obtain data from third parties. Our Products and Services are designed for adults only and we do not collect minors’ data knowingly.

The data we collect include but are not limited to:

identification data such as your name, surname, sex, address, driver’s license number, passport number, phone number;

  • sign-in and payment data;
  • identification data of the represented entity;
  • information related to the services that you bought;
  • biometric information and information regarding your appearance, face, voice, and mannerisms;

  • data related to the location you are at when using our Products and Services;
  • additional data depending upon the transaction.

Data processing

The information we collect is processed fairly and in accordance with applicable law. Our processing of personal data includes both automated and manual (human) methods of processing. To build, train, and improve the accuracy of our automated methods of processing, for example, artificial intelligence (AI), we manually review some of the predictions and inferences produced by the automated methods.

We use the data we collect to provide you with seamless experience while using our Services, to complete the transactions in which you are participating, to detect fraud, and to prevent crime.

We do not sell any of your information.

In particular, we use the collected data to:

  • improve and develop our Products and Services;
  • provide our Products and Services, which includes updating, securing, troubleshooting and providing support;
  • advertise and market to you, which includes sending promotional communications and presenting you with relevant offers;
  • operate our business, which includes meeting our legal obligations or doing research;
  • investigate or prevent frauds and crimes and violations of our contracts and policies.

Data storage and sharing

Documents, audio/video recordings and other related information will be stored and shared with you and any party with the required consent to access the information.

Legitify securely stores your data, including your personal information, meta data, documentation, and any other relevant information associated with a notarized transaction. We retain all your data as long as you have the account. When you close your account, we will keep the data as permitted and/or required by law. Once the retention time is reached, we will delete it. If we receive a legal process pertaining to your account, we will retain your data for as long as we in good faith believe is necessary to comply with the legal process. Similarly, if we believe that your account has been involved in wrongdoing, we may preserve your data to defend or assert our rights.

We also share some of the collected data with other parties that are involved in the transactions for which you use our Products or Services, and we transmit a notarized document to anyone you authorize. To provide the services you request, we also disclose some of the information we collect from you to service providers, contractors, or agents. We may also share your data with analytics providers which help us understand how customers are using our services. We may publicly disclose non-personal aggregated or anonymized information such as our number of visitors and registered users.

Also, we may transfer the information we have collected from you in cases of a proposed or actual merger or acquisition, or a sale of part of our business, or if we are involved in a bankruptcy and we might disclose it in order to comply with the law, a judicial proceeding, court order, or other legal process, such as in response to a court order, subpoena, or regulatory inquiry.

Some basic details about the transaction and the audio/video recording belongs to the notary. We store this information as a service to the notary. The notary has access to this information in our system. The notary is often required to produce the information (which includes the audio/visual recording) to certain interested parties, and sometimes to any member of the public who requests it. We direct requests like this to the notary, who will decide whether sharing is required. We may also monitor the video session you have with the notary to provide you with a quality service. We might also review the recording for similar purposes.

Our website might contain links to other websites hosted by third parties. We encourage you to read the Privacy Policy of each and every website that collects personal information. We do not control and thus are not responsible for any data policy or practices of such other websites.

Security

Legitify uses physical, technical, and organizational security measures to safeguard your data from unauthorized or accidental disclosure. Despite these efforts, no information system can be 100% secure, so we cannot guarantee the absolute security of your information. At the same time, we encourage you to use a unique and hard-to-guess password for your account and to not share it with others.

Marketing

Legitify would like to send you occasional promotional or informational emails related to Products and Services we offer, as well as those of our partner companies. You can opt-out of such communications at any time. If you do not wish to receive the promotional information, please let us know by contacting support@legitify.eu . We will still send you the emails regarding your account and Services you are using or other necessary notices.

We will not use Your Information to promote or advertise any third party’s products or services without your consent. If you provide consent, then you may opt-out at any time.

Cookies

We use cookies and other tracking mechanisms to track information about your use of our Products and Services to understand how you use our Products and Services. Most web browsers automatically accept cookies, but you can edit your browser options to block them in the future. In that case, some features of our Products and Services might not work correctly.

Google Analytics is a web analysis service that is offered by Google Inc. Legitify will seek your explicit consent prior to deploying non-essential cookies onto your device. Legitify utilizes essential cookies for functional purposes and non-essential cookies, such as Google Analytics' cookies, to enhance user experience and gather data analytics. Should you wish to decline or retract consent for non-essential cookies, certain features of our Products and Services might not operate as intended.

GDPR Compliance

1. Legal Basis for Processing

We process your data based on several legal grounds, as provided by the GDPR:

3.1. Some processes might be automated, like profiling. You have the right not to be subjected to solely automated decisions that have a significant impact on you. In such cases, you have the right to human intervention, express your point of view, and contest the decision.

4. Data Protection Impact Assessment (DPIA)

Whenever we embark on a new project that involves the processing of personal data which might result in a high risk to individuals' rights and freedoms, we will conduct a DPIA to determine and mitigate these risks.

5. Data Breach Notification

In the unlikely event of a data breach, we will inform the appropriate supervisory authorities within 72 hours, unless the breach is unlikely to result in a risk to your rights and freedoms. Affected individuals will also be informed if there's a high risk to their rights and freedoms.

6. Children’s Data

Legitify does not knowingly collect or process children’s data without verifiable parental consent. If you believe we have inadvertently collected such data, please contact us so we can promptly obtain parental consent or delete the data.


Do not track

We do not currently respond to “do not track” signals or other mechanisms that might enable consumers to opt-out of tracking on the Services.

Your data protection rights

  1. You have the right to request copies of your personal data.
  2. You have the right to request the correction of any information you believe inaccurate.
  3. You have the right to withdraw your consent to collecting your data.
  4. You have the right to restrict or object to processing your data.
  5. You have the right to request us to erase your information, although in some cases, we might not be able to do it because of contractual or legal requirements.
  6. You have the right to request the transfer of your data to another company.
  7. You have the right to lodge a complaint with supervisory authority.
  8. You have the right to request a copy of the data you provided to us in a structured, machine-readable format, and to transfer this data to another data controller.
